Lessee and Velotakas UAB, registered at Marcinkevičiaus str. 30, Vilnius, company code 302643966, hereinafter referred to as the Lessor, represented by Director Avitalis Maizelis, acting in accordance with the articles of association, have entered into the following rental agreement, hereinafter referred to as the Agreement:
1. Object of the Agreement
1.1. The Lessee acquires the right on the rental basis to possess and operate a bicycle,
TEXO,KROSS, MINERVA, PEGASUS, CUBE, UNIVEGA, GIANT, TREK, SCOTT, PROPHETTE, CUBE, OTHER ______________________ model ,
the price of which is Mountain Bike 705 EUR.City Bike 450 eur. Hybrid bike 550 EUR. Kross bikes 750 EUR. Electric bike 2000 EUR
2. Asset transfer and lease term
2.1. The Lessor hereby guarantees that the Asset is in good technical condition, suitable for use to its intended purpose, complete, free of any evident and hidden defects.
3. Lessee’s rights and obligations
3.1. The Lessee shall become responsible for preservation of the Bicycle from the moment of Bicycle acceptance;
3.2. All risks and liability for Bicycle destruction, loss, theft, damage or premature wear caused by the Lessee’s improper use or misuse of the Bicycle irrespective of recovery possibility shall be assumed by the Lessee according to Article 6.502 of the Civil Code of the Republic of Lithuania.
3.3. In case of theft, the Lessee must notify the Police and reimburse the Lessor for the value of the Bicycle specified in Paragraph 1.1 hereof.
3.4. The Lessee must return the Bicycle in good technical condition, in the same complete set as it was at the moment of signing the Agreement. The Bicycle must be free of scratches, may not be broken or deformed (dented), etc.
3.5. If the Bicycle is returned in the condition not satisfying the requirements laid down in this section, the Lessee must cover Bicycle defects’ repair expenses.
3.6. Liability for damages and losses caused to third parties, their means of transport and environment by the use and operation of the Bicycle shall be assumed by the Lessee.
3.7 Early cancellation of the agreement or early return will not be refunded
3.8 The vehicle should be picked up and returned in Bike Baltic Velotakas shop – A. Stulginskio 5, Vilnius, time and date stated in this agreement
3.9 Late return (hours) will be charged per hours according to the current rental price for one hour
4.0 Every delivery/ return in a different place than agreed will be charged with 30 EUR per each vehicle if
it is in Vilnius and 50 EUR if in a different town
4.1 Cleaning fee 5 EUR per bike may be charged in case the vehicle (tyres, transmission) is covered with mud
4.2 Personal information of the Lessee collected hereby shall be used solely for the purposes
of fulfilling the Agreement and in accordance with the General Data Protection Regulation
4.3 The Lessor shall not be liable for Lessee’s health impairments caused by the use of the Bicycle, and liability for health impairments resulting from an accident shall be assumed by the Lessee.
4.4 Any disputes related to this Agreement shall be settled through amicable negotiations. In case of failure to reach an agreement, disputes shall be settled following the procedure established by the laws of the Republic of Lithuania.
4.5 Extra insurance is an additional policy, which protects you from the ‘extra’ costs you would otherwise have to pay if your rented bike gets damaged. Insurance company will cover repair costs not more than 150 EUR
